In September 2021 the Scottish Government published guidance for public bodies on collecting and publishing data on sex, gender identity and trans status.
The definition of ‘sex’ in the Scottish Government guidance conflates biology, legal sex, and identity. The guidance also states that data on biological sex should only be collected and published in very limited circumstances. In practice, this means it is not possible to say what most of the data on ‘sex’ collected by Scotland’s public sector actually represents.
